The US Supreme Court upheld the invalidation of the total ban on handguns in DC. [District of Columbia v Heller]. Parsing the Second amendment into a prefatory clause - "Because a well regulated Militia is necessary to the security of a free State" - and an operative clause-"the right of the people to keep and bear arms" is not without controversy.
Copyright expert Bill Patry in The Patry Copyright Blog discusses how we interpret constitutional clauses and in particular contrasting the Second Amendment with Article I, section 8, clause 8 - a list of 18 clauses containing enumerating powers.
